This pocket-sized manual is an essential reference for law enforcement officers to ensure compliance with the stringent requirements of the Criminal Code and the Charter of Rights and Freedoms in the context of the police powers of arrest, search and seizure, and interrogation.
The ninth edition highlights all of the most important case law that has occurred since the last (Eighth) edition in 2002, on topics such as:
* defining the duty and responsibility of the police officers to prosecute offenders;
* recognizing the right of police officers to detain an individual where there are reasonable grounds to suspect that the individual is connected to a particular crime;
* defining good faith actions by the police; affirming the right to remain silent in the face of police questioning;
* directing when a police officer's employment records and disciplinary proceedings should be disclosed to the defence;
* directing how courts should determine whether a young person has waived his right to counsel, and;
* the so called "automatic exclusionary rule".
Also discussed in this edition are changes to the Criminal Code requiring third parties to produce documentation relevant to a criminal investigation and the use by the police of a general warrant. The Youth Criminal Justice Act of 2003 introduced by Parliament defining the policy and the manner in which young persons are to be treated by the police and the justice system is also reviewed.
The Honourable Roger E. Salhany, is a Justice of the Ontario Court (General Division). He is a frequent lecturer on criminal evidence and criminal procedure, and is the author of several works in this subject area.
