The 2009 Journal of the Canadian College of Construction Lawyers presents world class expertise on core subjects relevant to the construction industry. In past years the College’s focus has been on making available to the public papers from our annual conferences.
This year a departure was made by inviting a guest article for the Journal: “Adjudication and Mandatory Payment Requirements: “Good Practice” or “Good Riddance”?” by Stephen Dennison Q.C. and Zulfikar Khayum, both barristers of Atkin Chambers, London. Dennison and Khayum offer a thought provoking insight into the workings of uniform payment and performance legislation in the United Kingdom with guidance for Canada. In “Global Engineering and Construction ADR: Meeting an Industry’s Demand for Specialized Expertise, Innovation and Efficiency”, Philip L. Bruner surveys the broad scope of ADR methodologies that serve the international construction industry. Also included in this year’s publication are exceptional contributions from College Fellows including “Design Professional’s Liability for Field Services” a strong contribution. to the legal literature relating to the liability of design professionals authored by Brian S. Shapiro, Q.C. Matthew Alter and Ian Houston have contributed a valuable survey article entitled “Securing Payment and Performance on International Projects”. A remarkable collaborative effort: “Construction Liens Across Canada: An Updated 2009 Survey”. is an excellent compendium of the present state of lien law across Canada on a number of selected issues. Finally, American College of Construction Lawyers President (2008-2009), John Hinchey, and his co-author Troy Harris, published their impressive “International Construction Arbitration Handbook” last year which is reviewed in this Journal.
